15. LIMITATION OF LIABILITY

19. ARBITRATION AGREEMENT

  1. Binding Arbitration: Except for claims involving intellectual property or where otherwise prohibited by law, all disputes arising out of or related to these TOU shall be settled by binding arbitration on an individual basis.
  2. Class Action Waiver: Both parties waive the right to participate in any class, consolidated, or representative proceeding.

  4. Governing Rules: The arbitration will be conducted by a neutral provider, to be mutually agreed upon. If the parties cannot agree, a court may appoint a neutral arbitrator.
  5. Forum: If an in-person hearing is required, it will take place in or near Duluth, GA, unless otherwise required by law.
  6. Opt-Out: If you do not wish to be bound by this arbitration clause, you may opt out by sending a written notice within 30 days of first using the Site.

20. COPYRIGHTS

LoadStation respects the intellectual property rights of others. 24. MARKETING & USER CONTENT

  1. User Content: If you post or submit any content (e.g., reviews, comments) to the Site, you grant LoadStation a non-exclusive, worldwide, royalty-free license to use, modify, and display such content.
  2. Public Forums: Be aware that any information you post in public areas becomes public.
  3. Marketing: We reserve the right to identify you as a user or customer and use your name/logo in marketing, unless you email us an opt-out request.

25. TERMINATION

26. ENTIRE AGREEMENT
